Department of Hawaiian Home Lands

will submit a request to the
U.S. Department of Housing and Urban
Development (HUD)
for the release of
Native Hawaiian Housing Block Grant
funds under
Title VIII
of the
Native American Housing Assistance and Self
Determination Act
of
1996,
as amended, to undertake a project known as
single-family package home loan new construction,
for the purpose of
enabling an existing lessee to construct a new home at TMK (3) 2-1-
023:040 on the island of Hawai’i.
The activities proposed are Categorically Excluded under HUD regulations at 24 CFR
Part 58 from National Environmental Policy Act (NEPA) requirements. An
Environmental Review Record (ERR) that documents the environmental
determinations for this project is on file at DHHL’s office located at

each of the properties to be sold is an undivided ownership interest in the Projects and shall be sold separately to satisfy the Liens

payment by way of offset up to the amount of its
secured debt. Down payments must be made
payable to "Madeline Reed, Client Trust Account."
Down payment is subject to forfeiture in whole or in
part for failure to close. Potential bidders must
prove their ability to comply with 10% bid
requirement prior to participating in the public
auction. The balance of said purchase price is
payable upon approval and confirmation of the sale
by the Third Circuit Court, except Plaintiff may
satisfy the balance of the purchase price by way of
offset up to the amount of its secured debt. The
court will reopen the auction and accept bids at the
confirmation hearing on the condition that the
initial opening bid is at least five percent higher
than the highest bid received at the public auction.
Buyer is responsible for securing possession of the
property and all costs thereof, as well as all costs
of closing, including but not limited to costs of
conveyance, escrow, closing fees, conveyance
documents, recording fees, notary fees, consent
fees, conveyance taxes, proof of title, title
insurance, and any orders of the court.
Commissioner may require that the sale close
through an escrow, even if the Buyer does not
require one.
Neither the availability of title
insurance nor securing possession of the property
shall be a condition of closing. SALE SUBJECT TO
