          Hawaii Housing Finance and Development Corporation (HHFDC), Department

          public hearing on October 12, 2015 at 10:00 a.m. at the HHFDC Boardroom, 677
        
        
          Queen Street, Suite 300, Honolulu, Hawaii 96813, on the adoption of
        
        
          amendments to and compilation of Chapter 15-306, "General Excise Tax
        
        
          Exemptions," Hawaii Administrative Rules. All are invited to state their views on

          The proposed rule amendments implement Act 95, Session Laws of Hawaii
        
        
          2015, by adding in the law’s new minimum requirements to qualify for the
        
        
          General Excise Tax exemption. Also proposed are program fee increases, and a
        
        
          new section allowing the recertification of exemption of affordable rents for
        
        
          existing rental housing projects that have changed ownership, but otherwise still
        
        
          meet all program requirements.

          Suite 300, during regular business days from 7:45 a.m. to 4:30 p.m. It is also

          On August 25, 2015, the Board of Agriculture (Board) voted to designate Hawaii
        
        
          Island as an infested area for Ohia Wilt (Rapid Ohia Death), which is caused by a
        
        
          new strain of Ceratocystis fimbriata. The Board’s designation of Hawaii Island as
        
        
          an Ohia Wilt infested area authorizes the Hawaii Department of Agriculture (HDOA),
        
        
          Plant Quarantine Branch (PQB) under its rules to implement quarantine measures
        
        
          to prohibit the intrastate movement of Ohia plants, plant parts, including flowers,
        
        
          leaves, seeds, stems, twigs, cuttings, untreated wood, logs, mulch, and greenwaste;
        
        
          and frass from Hawaii Island except by permit issued by the HDOA. Effective
        
        
          January 1, 2016, soil will be included in the intrastate quarantine. The Board’s
        
        
          designation became effective on August 25, 2015.
        
        
          Ohia Wilt is a deadly fungal disease that is killing Ohia (Metrosideros
        
        
          polymorpha). Currently, there is no known cure for infected trees. Once symptoms
        
        
          appear the infected trees die within days to weeks. About 15,000 acres on Hawaii
        
        
          Island are known to be infested with Ohia Wilt. Ohia makes up 50% of the native
        
        
          forests and is a key component of Hawaii’s watersheds.
        
        
          The Board is authorized to designate an Ohia Wilt infested area to implement
        
        
          quarantine measures to prevent further spread of Ohia Wilt and its plant or
        
        
          commodity hosts from the designated infested area to restricted (uninfested) areas.
        
        
          The Board is also authorized to expand an Ohia Wilt infested area to prevent the
        
        
          further spread of Ohia Wilt. Due to findings of Ohia Wilt in Puna and Hilo, it was
        
        
          determined that an island wide quarantine for Hawaii Island is necessary to prevent
        
        
          the further spread of Ohia Wilt to other islands not known to have this destructive
        
        
          disease. So far, Ohia Wilt has not been detected on Maui, Lanai, Molokai, Oahu,
        
        
          and Kauai.
        
        
          The Board’s designation of Hawaii Island as an Ohia Wilt infested area means
        
        
          that movement or transportation of Metrosideros (all species in genus) (Ohia)
        
        
          plants, plant parts, including flowers, leaves, seeds, stems, twigs, cuttings,
        
        
          untreated wood, logs, mulch, and greenwaste; and frass is prohibited from an
        
        
          infested area to all other islands in the state except by permit issued by the HDOA.
        
        
          A permit may be issued by the PQB chief for the intrastate transportation of a
        
        
          commodity or item with conditions established by the chief. In addition, the chief is
        
        
          authorized to approve treatment and mitigative measures as they are scientifically
        
        
          validated and may revise permit conditions accordingly, as necessary to prevent the
        
        
          movement of Ohia Wilt from the infested area and to preserve the quarantine.
        
        
          Under the Board’s designation of Hawaii Island as an Ohia Wilt infested area,
        
        
          the intrastate movement of Metrosideros (all species in genus) (Ohia) plants, plant
        
        
          parts, including flowers, leaves, seeds, stems, twigs, cuttings, untreated wood, logs,
        
        
          mulch and greenwaste; and frass, from Hawaii Island to all other islands within the
